The Site is an informational website about InstaBud. Access to and use of the InstaBud mobile app, customer portal, and reports application are governed by separate agreements between you (or your organization) and DigsFact, not by these Terms.

You agree to use the Site lawfully and not to:

• Interfere with, disrupt, or attempt to gain unauthorized access to the Site or its systems.
• Use automated means to scrape or harvest content except as permitted by our robots.txt.
• Introduce malware or otherwise attempt to compromise security or availability.
• Use the Site to infringe others' rights or violate any law.

The Site and its content — including text, graphics, logos, images, and software — are owned by DigsFact or its licensors and protected by intellectual-property laws. "InstaBud," "DigsFact," and associated logos and mascots are trademarks of DigsFact, Inc.; you may not use them without our prior written permission. You may view and share Site content for personal, non-commercial informational purposes only.

If you send us information through a form or by email (for example, a demo request or message), you represent that it is accurate and that you have the right to provide it. Please do not send confidential or proprietary information you expect us to keep confidential; we may use feedback and suggestions without restriction.

InstaBud website content, sample reports, and interactive features are provided for general informational and illustrative purposes only. They do not constitute, and are not a substitute for, professional inspection, engineering, appraisal, insurance, claims-adjusting, or legal advice. Decisions about a property or a claim should be made with qualified professionals.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DIGSFACT AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

You agree to indemnify and hold harmless DigsFact from any claims, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your misuse of the Site or violation of these Terms.

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in Delaware for any dispute not otherwise subject to an applicable arbitration or dispute-resolution agreement.

We may update these Terms from time to time. Changes are effective when posted, and we will update the "Last updated" date above. Continued use of the Site means you accept the revised Terms.
